Do you actually have a survey of where the property line is?

Jason yes. And the ANC voted over a year ago to have the fence removed and recently sent a letter to DDOT asking why no action has been taken (see this month's hill rag). If you post your email, I can send you a PDF file from DC.gov showing the property line. If you look at the addition on the back of the house you can see it is angled where the property line is. The house in question owns no property south of it's southern brick wall and it's backyard is actually pie shaped angling north. The entire area enclosed by the fence (sans the pie shaped wedge directly behind the house) is not owned by the fence owner. A small pie shaped portion the width of a house and angling back to the house in the photo is in probate. The rest is public property.

"The Fence That Won’t Go Away

More than a year ago, the ANC voted in support of removing part of a fence at 768 13th St. SE. that encloses public property, exceeds height limits and that residents want to turn into a community garden. The fence is still there.

One by one, commissioners expressed frustration with DDOT for lack of enforcement and voted 9-1-0 to send a letter to DDOT director Terry Bellamy urging that the fence be taken down by the end of October. Commissioner Garrison voted against the resolution, saying he didn’t think a letter will help.

Commissioner Flahaven said, “The big question is why the fence is still there and we should focus on this fact,” rather than setting a deadline.

Commissioner Frishberg said that the letter will add to the record and that “We need to push DDOT and trigger a response.”

So DDOT, what is your excuse? Is it because the owner is politically connected and a former ANC rep? Why else has this taken 3+ years to resolve?
