The reported encampment is on City property, and recent federal court cases have restricted removal of homeless encampments on public property. In Martin v. City of Boise, the Ninth Circuit Court of Appeals issued a unanimous decision, finding that the City of Boise’s prohibition against sleeping in public violates the Eighth Amendment’s prohibition against cruel and unusual punishment when no alternative shelter is available. Thus, cities cannot enforce camping/lodging prohibitions if their local homeless population faces inadequate shelter space. However, the City will continue to monitor the location and assist with clean-ups when appropriate.

A court ruling cannot restrict Codes in Vallejo from being enforced. It is merely a legal precedent. Enforcement of the laws in our City is the code Enforcement Division’s purpose. No excuse regarding a Ninth Circuit Court decision is acceptable.

The Martin ruling allows cities to tell campers where they CAN CAMP and where they CAN NOT CAMP. COV's laissez faire approach misinterprets the extent of what's allowed under the ruling. Save our parks; save our wetlands; balance and enforcement require a clear understanding of the law, not platitudes and inaction.

@GiantsFanForever - I think my comment was misunderstood - I've been a home owner here for ten years and I am appalled by what the COV looks like now. I was applauding a clear understanding of the law and wishing our city govt would step up to the plate.

Why can't we do something about their vehicles driving in the park(s), like ticket them? Being homeless shouldn't release you from obeying all laws. VPD not GVRD gives tickets, so let's start calling 911 when you see a vehicle in one of our parks. Perhaps not driving into their encampment will be enough of a deterrent to move.

Because the current city of Vallejo has decided to move the Code Enforcement Division from the VPD to the Planning and Development Department. They are without power and only interested in generating profit from taxpayers?

Also, the problem created by the city and GVRD is caused by the Code Enforcement employees that are not doing their jobs in the first place.

To make matters worse the Permanent Homeless Manager position was created out of thin air and has no practical experience solving problems like this.
