    The house behind us at this address took down their six foot wooden fence all along the rear of the property and we can see their swimming pool. I thought code requires proper fencing and alarms to prevent pool accidents.

    June 16,2020 the Milton City Board of Zoning Appeals heard a petition for set back zoning variance on property located at 870 Owens Lake Rd in the Six Hills Subdivision. The property is owned by Gary Young. The adjoining property located at 145 Dorris Rd is owned by myself, Robert Brubaker. Since our 30 acre parcel adjoins Mr Youngs 10 acre parcel, Mr Young was seeking a variance to change the required building set back from 50 ft to 25 ft as the 5600 sq ft house he was planning to build would not fit in the allowable building site. This variance hearing was only discovered by pure chance after receiving a letter from Milton City notifing us, as adjacent land owners, that the hearing was scheduled in two days in case we objected. After reaching out to Mr Young and walking his property, he explained the limitations imposing the need for a variance to build so close to our property line. I asked Mr Young to postpone the hearing in order for me to examine the situation before facing the city council. He denied. While literally walking into the ZBA meeting, Mr Young approached me with his attorney and asked if we could reach an agreement to stop my objection to his variance request. I informed him and Mr David Adams, his attorney, that the only way I would not object to the variance was if he granted a 25ft non disturbed, perpetually forested easement along the entire length of our shared property line (+/-800ft). They agreed and we discussed this with the zoning board who agreed to note this on the deed and the land plat for Mr Young and all future owners. It was my intention that this would help protect the area immediately surrounding the fence line between our properties. Almost immediately Mr Young requested to remove 2 very large mature pine trees that sat adjacent to his building site. I stated the trees were healthy and would not be allowed to be cut down. After several incursions into the easement by construction and landscape crews, one of which was reported directly to Milton City Code Enforcement, Mr Young agreed to be more diligent in protecting our agreement. Fast Forward to 2pm Thursday May 16. I arrived home to my property to discover that Mr Young had a tree crew removing both of the aforementioned pine trees and several other trees around the easement. Since I cannot access the property, I can not verify if any of the other trees were within the easement or not. I walked to the fence at the property line and Mr Young met me. We proceeded to discuss the situation and he informed me that the building examiner who had inspected the house for the CO had told him one of the trees was dying and could be cleared out. Mr Young stated that he texted me his plans but I never received any notice that this action was being undertaken. I am asking for an enforcement check of the entire easement agreed to and proper documentation on any/all unauthorized clearing or disturbances. I contacted Mr Michael Cardamon (sorry if spelling is incorrect) at Milton City and he suggested I start with this online report. At this point I plan seek any and all legal remedies available since I feel agreement has clearly been violated.
